These Terms of Service ("Terms") govern your access to and use of total-advantage.net, its online forms, and related communications and services provided by Total Advantage Solutions LLC ("Total Advantage Solutions," "we," "us," or "our"). By accessing the website, submitting a form, or using our services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the website or services.

Total Advantage Solutions assists real estate investors and professionals with business-purpose real estate financing inquiries and related referral relationships. The website is not intended for consumer-purpose or owner-occupied residential mortgage applications.

Website content and preliminary communications are for general informational purposes. They are not a commitment to lend, a loan approval, a guarantee of financing, or an offer of specific credit terms. Programs, rates, leverage, fees, eligibility, and approvals depend on borrower, guarantor, property, lender, location, documentation, underwriting, and current program requirements. Final terms are stated only in applicable written transaction documents.

You must be at least 18 years old and have legal capacity to use the website and services. If you act for a company or another person, you represent that you have authority to provide the information and act on that party's behalf.

If you provide information about another person, you represent that you are permitted to provide it for the stated purpose. Providing another person's telephone number does not give consent for us to send that person automated text messages. The person must separately provide any consent required for such messages.

You agree to provide information that is accurate, current, and complete and to update it when necessary. We may rely on information you provide when evaluating an inquiry or presenting a potential transaction to financing or transaction participants. We may decline, suspend, or stop processing an inquiry if information appears false, incomplete, misleading, unauthorized, or unlawful.

Submitting a referral-partner form does not by itself create an agency, employment, brokerage, joint venture, exclusivity, or compensation agreement. Referral eligibility, responsibilities, compensation, payment timing, licensing requirements, and restrictions are governed by a separate written agreement, if any, and applicable law. No compensation is earned solely by submitting a form or referral.

When you provide an email address or telephone number, you authorize us to respond to your inquiry and send communications that you specifically request or separately consent to receive. You are responsible for keeping your contact information current and for any charges imposed by your communications provider.

Program and Message Types

Total Advantage Solutions may offer two text messaging categories. Non-marketing messages may include responses to inquiries, deal or application updates, document requests, appointment or task reminders, transaction communications, customer service, and referral-partnership communications. Marketing messages may include information about business-purpose financing programs, services, events, company news, and promotions.

How You Opt In

You opt in only when you take an affirmative action, such as checking the applicable optional SMS consent box and submitting the form. Marketing consent is separate from non-marketing consent. The boxes must not be preselected. Consent to marketing texts is not a condition of purchasing a product or service, submitting a deal, or applying to become a referral partner.

Automated Messages

By providing the applicable consent, you agree that messages may be sent using automated technology or an automated system to the telephone number you provided. Your consent applies only to the message category selected and does not authorize unrelated messages.

Frequency and Charges

Message frequency varies based on your interactions, transaction activity, and communication preferences. Message and data rates may apply. Contact your wireless provider for information about your plan.

Opting Out

You may opt out of text messages at any time by replying STOP. You may also use another reasonable method communicated to us, including contacting us at 574-406-0368 or dominick@total-advantage.net. After an opt-out request, we may send one confirmation message and then stop messages covered by the request. You may later opt in again by providing new consent.

Telephone Number Changes

If you stop using or transfer a telephone number, notify us promptly so we can update our records. Do not provide a telephone number that you do not own or control unless you are authorized to use it for the requested communications.

Delivery and Carrier Responsibility

Text delivery is subject to carrier and network availability and is not guaranteed. Wireless carriers are not liable for delayed or undelivered messages. We may change, suspend, or end a messaging program as permitted by law and will honor valid opt-out requests.

Text Messaging Privacy

Our collection and use of information in connection with text messaging are governed by our Privacy Policy at https://www.total-advantage.net/privacy-policy. We do not share mobile phone numbers, SMS opt-in records, or text-message consent with third parties or affiliated companies for their marketing or promotional purposes.

You may use the website only for lawful purposes. You may not:

• Provide false, misleading, fraudulent, or unauthorized information.
• Use the website to violate a law, regulation, contract, privacy right, intellectual property right, or other legal right.
• Attempt to gain unauthorized access to the website, accounts, systems, or data.
• Interfere with website operation, introduce malicious code, scrape the website through automated means without permission, or circumvent security measures.
• Impersonate another person or misrepresent your identity, authority, or relationship with another party.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limits obligations in a separate written agreement signed by us.

To the extent permitted by law, you agree to indemnify and hold Total Advantage Solutions harmless from third-party claims, losses, and reasonable expenses arising from your unlawful use of the website, material violation of these Terms, or unauthorized submission of another person's information. This section does not require indemnification for conduct caused solely by Total Advantage Solutions.

We may update these Terms from time to time. We will post the revised Terms on this page and update the effective date. Changes apply prospectively when posted unless a later date is stated. Continued use of the website after the effective date constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles, except where federal law or another jurisdiction's mandatory law applies. Subject to applicable law and any separate written agreement, legal proceedings concerning these Terms or the website must be brought in a court of competent jurisdiction located in St. Joseph County, Indiana.

If a provision of these Terms is held unenforceable, the remaining provisions remain in effect to the extent permitted by law. Our failure to enforce a provision is not a waiver of that provision or any other right.
